Senior Partner Ronald Deneweth and Partner Jacob Kahn obtained a favorable result in a breach of contract and lien bond dispute on behalf of a mechanical contractor that performed work on the historic St. Clair Inn. For over two years, the owner refused to acknowledge the properly performed work of the mechanical contractor and made unsubstantiated allegations of defective work and backcharges. Following a four-day bench trial before Judge Michael West, the Court found that the mechanical contractor was entitled to a judgment in the full amount of its principal claim. In addition, the Court found that the owner could not support its alleged counterclaims. Subsequently, the Court entered an order finding that the mechanical contractor was also entitled to its actual attorneys’ fees, interest, and costs.
